ORDER. The Court has read and appreciates the arguments of both sides regarding the absence of the CIGNA Plan Administrator as a party to this action. However, the Court also believes that the parties' arguments may be hypothetical, given the possibility of amending the pleadings under Rules 15 and 21 of the Federal Rules of Civil Procedure. Under Rule 21, "[p]arties may be dropped or added by order of the court on motion of any party or of its own initiative at any stage of the action and on such terms as are just." (Emphasis added). The Administrator here clearly had notice of the suit and would have been represented by the same counsel as represented CIGNA. Furthermore, the Court notes that Rule 15 allows for relation back of such amendments where "but for a mistake concerning the identity of the proper party, the action would have been brought against the party." Fed. R. Civ. P. 15(c)(3)(B). Accordingly, the Court orders the parties to file simultaneous briefs no later than October 8, 2007, on whether the Plan Administrator should or could now be added to this action in order to avoid the arguments occasioned by his absence from the case.
