Recent court decisions regarding Engers v. AT&T Managment Pension Plan, C.A. 98-3660 (D.N.J.) include the following:

  • Plaintiffs asked the Court to conditionally certify Claims One and Two as a collective action under the ADEA.  On May 24, 2007, the Court granted that motion. As a result, notices will be mailed to over 40,000 individuals who fit the class definition. The notices will give those individuals an opportunity to "opt-in" to the collective action by signing a one-page consent to join form.   • The Court’s March 29, 2007 decision denying AT&T’s motion to dismiss Claims One and Two (the age discrimination claims).
  • The Court’s January 3, 2007 decision denying Plaintiffs’ motion for summary judgment and Defendants’ motion to dismiss the claims about “backloading” of benefits and excessively reducing benefits for retirements before age 55.
